Acceptance of Terms By accessing, purchasing, signing up for, or using any service offered by Hermox Document Solutions LLC, including our website, consultations, document preparation services, templates, guides, communications, AI-assisted tools, BlockMyDebt services, or related materials, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. All services are provided for educational, informational, and self-help document preparation purposes only. 3. Legal Disclaimer Hermox Document Solutions LLC is not a law firm. We do not provide legal advice, legal representation, or attorney services. Nothing provided through our website, services, communications, documents, templates, guides, AI-assisted tools, or educational materials constitutes legal advice or the practice of law in any jurisdiction. Your use of Hermox Document Solutions LLC or BlockMyDebt does not create an attorney-client relationship. We do not: Represent you in court; Appear at hearings for you; File documents with any court on your behalf; Serve documents on any party on your behalf; Communicate with opposing counsel, creditors, collectors, courts, arbitration providers, or third parties on your behalf; Provide legal advice; Select legal strategies for you; Tell you what legal claims, defenses, motions, or arguments you should raise; Guarantee any legal, financial, collection, settlement, garnishment, judgment, or court outcome. You are solely responsible for all legal decisions you make, all documents you review, all documents you sign, all documents you file or submit, all court appearances, and all deadlines related to your matter. No Debt Settlement, Debt Relief, Debt Negotiation, Debt Collection, or Fund-Holding Services Hermox Document Solutions LLC and BlockMyDebt do not provide debt settlement services, debt relief services, debt negotiation services, debt consolidation services, credit repair services, debt collection services, or legal representation. We do not: Negotiate debts on your behalf; Communicate with creditors, debt collectors, opposing counsel, courts, or third parties on your behalf; Collect debts; Collect, hold, escrow, transmit, or distribute settlement funds; Manage payment plans with creditors or collectors; Promise or represent that any debt will be reduced, dismissed, deleted, settled, or eliminated; Promise or represent that any lawsuit, judgment, garnishment, bank levy, lien, or collection action will be stopped, reduced, dismissed, vacated, or resolved; or Provide any service requiring a law license, debt-settlement license, debt-adjuster license, credit-services registration, or other professional license or registration unless legally permitted and properly authorized. Any settlement-related service we offer is limited to Settlement Letter Preparation, meaning we may prepare written settlement-related documents or letter templates based on information you provide for your own review and use. You remain solely responsible for deciding whether to send any settlement-related document, negotiating or communicating with any third party, making or accepting settlement offers, making payments, and determining whether a settlement is in your best interest. 5. BlockMyDebt Service Line BlockMyDebt is a self-help document preparation service offered by Hermox Document Solutions LLC. BlockMyDebt is not a separate law firm, debt relief company, debt settlement company, debt negotiation company, debt collection agency, or legal services provider. Hermox Document Solutions LLC is the legal operating entity, billing entity, merchant of record, customer support provider, refund-policy administrator, and document preparation provider for all BlockMyDebt services. All BlockMyDebt services are subject to these Terms, any applicable BlockMyDebt client agreement, our Privacy Policy, and any checkout or service disclosures provided at the time of purchase. 6. Customer Responsibilities By using our services, you acknowledge and agree that: You are responsible for reviewing all documents before signing, filing, mailing, serving, submitting, or using them; You are responsible for verifying the accuracy of all names, dates, addresses, account numbers, balances, case numbers, court information, facts, and allegations; You are responsible for determining whether any document is appropriate for your specific facts, court, jurisdiction, and circumstances; You are responsible for meeting all court deadlines, filing deadlines, service deadlines, hearing dates, response dates, and procedural requirements; You are responsible for filing, serving, mailing, or submitting documents yourself; You are responsible for attending all court dates, hearings, conferences, mediations, arbitrations, or other proceedings; You are responsible for all communications with courts, creditors, collectors, opposing counsel, arbitration providers, and third parties; You are responsible for deciding whether to consult or hire a licensed attorney; You understand that failing to comply with court rules, deadlines, or service requirements can result in serious consequences, including default judgment, wage garnishment, bank levy, lien, sanctions, or loss of rights. 7. Use of AI-Assisted Tools Some Hermox Document Solutions LLC and BlockMyDebt services may use artificial intelligence or AI-assisted tools for intake review, document analysis, case summary generation, educational explanations, workflow support, or draft preparation. By using our services, you acknowledge and agree that: AI-generated content is for educational, informational, and document-preparation support purposes only; AI-generated content does not constitute legal advice; AI tools may produce outputs that are incomplete, inaccurate, outdated, misleading, or unsuitable for your specific facts, court, jurisdiction, or circumstances; You are solely responsible for reviewing, verifying, and determining the suitability of any AI-generated content before relying on it or using it; We do not warrant the accuracy, completeness, reliability, legal sufficiency, or fitness of any AI-generated output for any purpose. 8. Payment and Billing All fees are due in full at the time of purchase unless a written split-payment arrangement is approved. Hermox Document Solutions LLC is the billing entity and merchant of record for all Hermox and BlockMyDebt transactions. By completing a purchase, you authorize Hermox Document Solutions LLC to charge your selected payment method for the full amount of the applicable fee. If a split-payment arrangement is approved, you authorize us to charge your payment method according to the agreed payment schedule. 9. Refund Policy Because our services involve custom document preparation based on your specific information, facts, documents, deadlines, and matter type, fees are non-refundable once document preparation has begun. Once document preparation has begun, no refund will be issued based on non-use of the documents, dissatisfaction with a legal or financial outcome, change of mind, resolution of your matter before using the documents, failure to file or use the documents, missed deadlines, court rejection, opposing-party response, settlement rejection, unfavorable ruling, or any other reason, except as required by applicable law or as otherwise approved by Hermox Document Solutions LLC in its sole discretion. If you believe there has been a billing error, contact us within five business days of the charge so we can review and attempt to resolve the issue. 10. Chargebacks and Payment Disputes We encourage you to contact us directly before initiating a chargeback or payment dispute so we can attempt to resolve any billing or service concern. Nothing in this section limits any rights you may have under applicable law or card-network rules. If a chargeback or payment dispute is determined by the card issuer, payment network, arbitrator, court, or other authorized decision-maker to be knowingly false, fraudulent, or submitted in bad faith after services were provided or document preparation had begun, you may be responsible for a chargeback processing fee of up to $150, to the extent permitted by applicable law, in addition to any amounts properly owed for services provided. Your electronic acceptance of these Terms, payment records, intake submissions, access logs, work records, communications, document-preparation records, and delivery confirmations may be used as evidence of your purchase, authorization, receipt of services, commencement of work, and agreement to these Terms in any billing review, payment dispute, arbitration, court proceeding, or chargeback response. 11. No Guarantee of Outcome Hermox Document Solutions LLC and BlockMyDebt make no representations, warranties, promises, or guarantees regarding the outcome of any lawsuit, document filing, arbitration request, settlement letter, garnishment-related document, default judgment-related document, debt validation letter, business document, consumer document, or other legal, financial, administrative, or debt-related matter. Outcomes depend on many factors outside our knowledge and control, including: The facts of your matter; The documents and evidence involved; The jurisdiction, court, judge, clerk, arbitrator, or hearing officer involved; Your compliance with court rules, filing requirements, service requirements, and deadlines; The conduct of other parties; The strength or weakness of another party’s evidence; Whether you properly review, sign, file, serve, mail, or submit documents; Changes in applicable law, rules, or procedures; Decisions made by you or any third party. The fact that another customer may have obtained a favorable result does not guarantee that you will obtain the same or any favorable result. Any testimonials, examples, educational illustrations, or prior outcomes are not promises, predictions, or guarantees of future results. 12. Service Availability and State Compliance We provide self-help document preparation services only where legally permitted. We reserve the right to decline, limit, suspend, or refund any service request if we determine, in our sole discretion, that the requested service may require licensing, registration, attorney involvement, court authorization, or activity we do not provide. The availability of any service through Hermox Document Solutions LLC or BlockMyDebt does not constitute a representation that such service is appropriate, sufficient, lawful, or available in your specific state, county, court, jurisdiction, or circumstances. Certain states, courts, or jurisdictions may have specific requirements regarding legal document preparers, debt settlement companies, credit services organizations, debt adjusters, consumer-assistance providers, unauthorized practice of law rules, court filings, debt-related communications, garnishment procedures, default judgment procedures, arbitration, or other matters. You are responsible for understanding and complying with the laws, rules, procedures, and requirements that apply to your matter. 13. Uploaded Documents and User Content You may be asked or permitted to upload legal documents, court filings, collection letters, account statements, credit documents, correspondence, identification information, financial information, or other materials in order for us to provide document preparation services. By providing content to us, you represent and warrant that: You have the legal right to provide the content; The content is accurate and complete to the best of your knowledge; The content does not violate any applicable law, court order, confidentiality obligation, or third-party right; You understand that inaccurate, incomplete, outdated, or misleading information may result in inaccurate or unsuitable documents. By providing content to us, you grant Hermox Document Solutions LLC a limited, non-exclusive, royalty-free license to process, review, analyze, store, and use such content solely for the purpose of providing services to you, administering your account, complying with law, resolving disputes, improving internal quality control, and maintaining business records. We will not sell your uploaded documents. 14. Communications Consent By providing your phone number, email address, or other contact information and using our services, you consent to receive communications from Hermox Document Solutions LLC and, where applicable, BlockMyDebt. These communications may include: Transactional messages related to your account, purchase, payment, intake, and service status; Appointment reminders and scheduling confirmations; Follow-up messages requesting documents, information, signatures, or clarification; Service updates and document status notifications; Educational content related to your matter or the services; Customer support communications. Communications may be sent by SMS text message, email, phone call, voicemail, or other electronic means, including through automated dialing, messaging, or scheduling systems where permitted by law. Message and data rates may apply. Message frequency will vary. To opt out of SMS messages, reply STOP to any text message you receive from us. To opt out of marketing emails, click the unsubscribe link in any marketing email. Opting out of transactional messages may affect our ability to provide services or important service notifications. 15. Personal Use and Prohibited Conduct All documents, templates, guides, instructions, educational materials, analyses, summaries, AI-assisted outputs, and related materials provided by Hermox Document Solutions LLC are licensed to you for personal, non-commercial use solely in connection with your own matter. You may not: Share, sell, resell, sublicense, publish, upload, distribute, or publicly display materials obtained from us; Use materials to create competing products, services, platforms, templates, guides, bots, workflows, or tools; Use the services for any unlawful, fraudulent, abusive, harassing, or improper purpose; Misrepresent your identity, facts, documents, case status, court deadlines, or other information submitted to us; Reverse engineer, copy, scrape, replicate, or reproduce any aspect of our systems, templates, workflows, prompts, or proprietary tools. Violation of this section may result in immediate suspension or termination of access without refund and may expose you to legal liability. 16. Intellectual Property All content, software, tools, templates, workflows, prompts, forms, guides, educational materials, analyses, document structures, branding, trade names, trademarks, service marks, logos, platform features, and related materials are owned by Hermox Document Solutions LLC or its licensors. You may not reproduce, modify, distribute, publish, sell, resell, create derivative works from, publicly display, scrape, reverse engineer, or otherwise exploit any portion of our services or materials without prior written permission from Hermox Document Solutions LLC. All rights not expressly granted are reserved. 17. Privacy and Data Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, storage, and sharing of your information as described in our Privacy Policy. Hermox Document Solutions LLC may collect and process sensitive personal information, including legal documents, court documents, financial information, contact information, identifying information, case information, payment-related information, and communications. We implement reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission, storage, or electronic processing is completely secure, and we cannot guarantee absolute security. We will not sell your personal information to third parties. 18. Disclaimer of Warranties The services and all materials are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Hermox Document Solutions LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, legal sufficiency, and suitability for any particular matter, jurisdiction, court, or purpose. We do not warrant that the services will be uninterrupted, error-free, secure, timely, complete, or free from defects. We do not warrant the accuracy, completeness, reliability, or legal sufficiency of any document, template, guide, educational material, AI-generated output, or other material. We do not warrant that the services will meet your specific needs or produce any particular result. 19. Limitation of Liability To the fullest extent permitted by applicable law, Hermox Document Solutions LLC, BlockMyDebt, and their owners, officers, employees, contractors, agents, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of or inability to use the services or materials. This limitation includes, but is not limited to, loss of data, loss of profits, loss of opportunity, adverse legal outcomes, court judgments, default judgments, wage garnishments, bank levies, liens, collection activity, settlement rejections, missed deadlines, filing rejections, procedural errors, sanctions, or any other financial or non-financial harm. To the fullest extent permitted by applicable law, our total cumulative liability to you for all claims arising out of or related to these Terms or the services shall not exceed the total amount you actually paid to Hermox Document Solutions LLC for the service giving rise to the claim during the three months preceding the claim. Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the maximum extent permitted by law. 20. Indemnification You agree to defend, indemnify, and hold harmless Hermox Document Solutions LLC, BlockMyDebt, and their owners, officers, employees, contractors, agents, affiliates, and service providers from and against any and all claims, damages, losses, liabilities, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: Your use or misuse of the services or materials; Any content, document, fact, or information you upload, submit, or provide; Your violation of these Terms; Your violation of any applicable law, regulation, rule, court order, or third-party right; Your filing, service, mailing, submission, or use of any document or material; Any legal, financial, debt-related, collection, garnishment, judgment, settlement, arbitration, or court matter in which you use materials obtained from us; Any inaccurate, incomplete, false, outdated, or misleading information you provide. 21. Termination and Suspension Hermox Document Solutions LLC reserves the right to suspend or terminate your access to the services at any time, with or without notice, for any violation of these Terms, suspected misuse or abuse, suspected fraudulent activity, nonpayment, unauthorized sharing, prohibited conduct, initiation of a payment dispute, security concern, legal or compliance concern, or any other reason we deem appropriate in our sole discretion, subject to applicable law. Upon termination, your license to use all materials ends immediately. No refund will be provided for any terminated account where document preparation has begun, except as required by applicable law or as otherwise approved by Hermox Document Solutions LLC in its sole discretion. 22. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law principles. For any matters not subject to mandatory arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Macomb County, Michigan, unless applicable law requires otherwise. To the fullest extent permitted by applicable law, any claim you may have against Hermox Document Solutions LLC or BlockMyDebt must be brought within one year of the date the claim arose, or it will be permanently barred. 23. Mandatory Arbitration and Dispute Resolution Please read this section carefully. It affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms, the services, your purchase, your use of materials, communications, billing, refunds, chargebacks, privacy, or any question regarding the existence, validity, interpretation, breach, termination, or enforceability of these Terms shall be resolved exclusively through binding individual arbitration rather than in court, except that either party may assert claims in small-claims court if the claims qualify. The arbitration shall be conducted by a single neutral arbitrator under the Consumer Arbitration Rules of the American Arbitration Association, available at www.adr.org, unless the parties agree to another arbitration provider or applicable law requires otherwise. The arbitration shall take place in Macomb County, Michigan, or, at your election, by telephone, video conference, or written submissions, where permitted by the applicable arbitration rules. If AAA Consumer Arbitration Rules require Hermox Document Solutions LLC to pay certain arbitration fees or costs, Hermox Document Solutions LLC will do so as required by those rules. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. 24. Class Action Waiver To the fullest extent permitted by law, you agree that all claims against Hermox Document Solutions LLC, BlockMyDebt, and their owners, officers, employees, contractors, agents, affiliates, or service providers must be brought in your individual capacity and not as a plaintiff, class member, collective member, or representative in any purported class action, collective action, private attorney general action, or representative proceeding. You waive any right to have your claims heard or resolved as a class, collective, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any class, collective, representative, or private attorney general proceeding, except to the extent such waiver is prohibited by applicable law. 25. Miscellaneous Entire Agreement These Terms, together with our Privacy Policy, Refund Policy, any signed service agreement, and any checkout disclosures incorporated by reference, constitute the entire agreement between you and Hermox Document Solutions LLC with respect to the services. If there is a conflict between these Terms and a separate signed service agreement, the more specific provision will control unless otherwise stated. Severability If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. No Waiver Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No Partnership or Agency Nothing in these Terms creates a partnership, joint venture, employment, franchise, agency, attorney-client, fiduciary, or professional-advisory relationship between you and Hermox Document Solutions LLC, BlockMyDebt, or any related person or entity. Assignment You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, subject to applicable law. Survival Any provisions that by their nature should survive termination shall survive, including payment obligations, refund limitations, intellectual property rights, disclaimers, limitation of liability, indemnification, arbitration, class action waiver, governing law, and personal-use restrictions. 26.
